Since 2003, N’JOY has built up a solid reputation in Switzerland in the field of automotive equipment installation, with a particular focus on Volkswagen Group brands.

We are delighted to offer you our products and services and wish you a pleasant online ordering experience.

  1. YOUR CONTRACT WITH US

These Terms and Conditions of Sale (T&C or Terms) apply to all services and product orders that you, as a customer, place with N’JOY on its websites and applications (“the Sites”). By placing an order, you acknowledge that you have read, understood and accepted these Terms without reservation.

We reserve the right to modify the present Terms at any time by publishing a new version on our Sites. Any order placed after the publication of the new version of the Terms implies acceptance of these Terms.

By using our Sites, you also agree to be bound by our Terms of Use and Privacy Notice. Please read them carefully.

 

  1. OUR PRODUCTS, SERVICES AND THEIR AVAILABILITY
  • Our products

We offer a wide range of automotive equipment and accessories from many brands, including Volkswagen, Audi, Seat, Cupra, Porsche, Skoda within the limits of available stock (“our products”). All our products are second-hand or almost new (dismantled after short use). Exceptionally, our stock may contain new products and these are indicated as such.

The products available on our sites are unique and sold “as is”, taking into account their degree of use, year of production and other characteristics. They have nevertheless passed a quality control test (whether or not they have been repaired by us) and are in working order.

Each product has an individual number and a technical figure (“part number” or production number) enabling the customer to assess the product’s compatibility with certain vehicles. In some cases, it is necessary to have the vehicle’s chassis number to be certain of compatibility. Warning: some of our products, due to their specific nature, require an expertise prior to purchase and will not be sold without such expertise.

With the purchase of one of our products, we offer the following expertises:  

  1. On-site installation on our premises
  2. Remote installation support (virtual support via videoconference or telephone)
  3. Analysis of product compatibility with the customer’s vehicle 
  4. Advice on one or more technical questions

 

How to proceed : 

By clicking on “expertise request” you can submit a service request to N’JOY. Once N’JOY has assessed your request, an offer will be sent to you by email. Once the offer has been accepted, N’JOY will contact you to make an appointment either by telephone or by email. The quotation will indicate an estimated price for the service based on a virtual estimate of the case, but the final price may vary according to unforeseen stock, configuration or actual vehicle requirements. 

Any cancellation or modification of an appointment less than 24 hours in advance may be billed to the customer. 

 

  1. WHO CAN BUY OUR PRODUCTS AND BENEFIT FROM OUR OFFERS

Our products may only be purchased by individuals over the age of 16, and by automotive professionals (mainly garages and workshops) domiciled or based in Switzerland, the European Union and the UK.

  1. Ordering a product and/or service as a professional: a request for an offer can be made on our Sites before ordering several products via the customer account. N’JOY is free to propose or not an offer to the professional customer depending on the number of products and/or services ordered as well as their value. The offer is limited in time, specific to the customer and to the products and/or services in question, and cannot be accumulated.
  2. Ordering a product and/or service as an individual: no special offer applies. 

 

  1. REGISTRATION AND CUSTOMER ACCOUNT

Both private and professional customers can browse our Sites and place orders as guests or via a customer account. Requests for offers can only be made via a customer account and on behalf of our professional customers (garages, workshops, etc.).

To create a customer account, all you need to do is share a certain amount of information, such as: first and last name, telephone number, email address, private and/or business address, company number (SIRET number). You will also access your purchase history.

You are responsible for ensuring that the personal data you provide is true, accurate and up-to-date before placing an order. Please ensure that the password you choose when registering for your customer account remains confidential and is not disclosed to anyone.

 

We reserve the right to refuse to sell our products and services and/or to terminate an account without notice if it violates these Terms or if we decide that it is in the best interest of N’JOY.

 

  1. PRICES AND TAXES

Prices are quoted in Swiss francs (CHF) and apply to the products and services offered at the time you place your order.

VAT is included in the purchase price when the order is delivered in Switzerland. 

When delivery takes place outside Switzerland, the price will be displayed excluding VAT and will be calculated and charged to the customer upon delivery by the logistics partner.

 

  1. TERMS OF PAYMENT AND RESERVATION OF OWNERSHIP

Private customers can pay for products and services by credit card and Twint. On request, professional customers can pay by bank transfer. If payment is made by credit card, the credit card will be debited with the purchase price once the order has been completed. Under no circumstances may the customer offset payments due against other claims.

Products remain the property of N’JOY until receipt of the purchase price.

Prices for services are due no later than 14 days after they have been provided. 

  1. TERMS OF DELIVERY

 

Delivery costs

Delivery costs for items delivered within Switzerland are borne by N’JOY (up to a maximum of CHF 50.-) and include postage and packing. 

Delivery costs outside Switzerland and within the European Union and England are at the customer’s expense. These costs are calculated when the order is placed. 

Additional costs not included in the price of the goods (customs duties and VAT) apply to shipments outside Switzerland. These costs are borne by the customer.

 

Delivery address

You can either choose to receive the products at a delivery address, or collect them from our store. Orders are delivered by registered mail and handed over against a signature at the address provided at the time of placing the order. 

N’JOY declines all responsibility for inaccurate or incomplete addresses. In the event of non-receipt or loss of merchandise due to the customer’s fault or negligence, total or partial reimbursement of the merchandise is excluded.

 

Delivery time

We process orders received before 3pm on the same day or within 48 hours from Monday to Friday, excluding public holidays. Delivery times in Switzerland are approximately 2-3 working days. Delivery times to Europe and the UK can vary from 3-5 days. These times are indicative and may vary. In the event of absence (vacations), online purchases may be suspended.

If an order is received on a Saturday, Sunday or public holiday, it will normally be processed on the next working day (Monday to Friday). Longer delivery times are to be expected for orders placed before public holidays.

N’JOY is not responsible for delays in delivery caused by the carrier or any other cause beyond its control. If the agreement cannot be fulfilled due to force majeure as defined by jurisprudence, N’JOY’s liability is exonerated.

 

  1. RETURN POLICY

 

  • Returns and product conformity

You have the right to exercise your right of withdrawal for any product that does not suit you within fourteen (14) days of receipt. To do so, please first notify N’JOY clearly of your wish to withdraw by e-mail to [email protected] using the template below. (A simple return of the product without prior notification to the seller will not be accepted as a valid return).

Once N’JOY has validated your purchase withdrawal, you have 14 days to return the product to us. 

N’JOY will only accept the return of undamaged and unused products in their original condition with packaging and invoice. The customer is responsible for any depreciation in the value of the products following receipt.

Any product not complying with the terms of return or product conformity will be:

  • Returned to the customer at the customer’s expense. Return shipping cost must be prepaid by the customer
  • If the return costs are not prepaid by the customer, N’JOY reserves the right to keep the products on its premises until they are collected by the customer. The risks shall pass to the customer.

Note : products made to your specifications or clearly personalized products whose manufacture requires special adaptations to meet precise technical requirements cannot be returned.

  • Refund 

N’JOY will reimburse you using the same payment method chosen by you for the purchase transaction. Delivery and return postage costs are borne by the customer and N’JOY will reimburse the customer within 14 days of receipt if the returns are in accordance with the return policy and the products meet expectations as defined above. N’JOY will not reimburse any additional costs arising from the fact that you have chosen a delivery method other than the standard delivery method.

 

Returns can be made free of charge directly to the store during opening hours. Following receipt, N’JOY reserves the right within a reasonable period of time (14 days at the latest) to analyze the conformity of the products with the return policy and to reimburse the customer in full, in part or not at all, depending on their conformity with the return policy.

 

  1. Warranty

Second-hand products sold by N’JOY, installed by N’JOY or not, are guaranteed for 1 year from the date of purchase or order confirmation. New products sold by N’JOY, installed by N’JOY or not, are guaranteed for 2 years from the date of purchase or order confirmation.

 

Excluded cases:  

The warranty does not apply in the following cases:  

  • Damage resulting from an external cause (including, but not limited to: accident, disassembly, repairs, modifications, falls, impacts, exposure to inadequate storage conditions such as humidity and heat);
  • Problems arising from improper use of the product or other external interventions (e.g. installation on an unsuitable vehicle, use of incompatible accessories or poor maintenance, improper circuit connections, falls, impacts or humidity, exposure to certain liquids);
  • Normal wear and tear of the product.

Warranty activation procedure: 

  1. Contact us
  1. a) Either by visiting our store with the complete product and proof of purchase (store invoice or online order confirmation)*. 
  2. b) Or by contacting us by e-mail at :[email protected] with the following information* : 
  • Full name, delivery address and telephone number
  • Copy of invoice or proof of purchase
  • Item description with item number (if applicable)
  • Photo of package and/or product
  • Information on the reasons for activating the warranty

 

*N’JOY reserves the right to request any further information or evidence it deems necessary. 

  1. N’Joy will contact you as soon as possible (within 2,3 working days) to confirm whether or not we accept the return of the product for quality control.
  2. If the return is accepted by N’JOY, the product must be sent to the following address: N’JOY Shop, Route de Trélex 10, 1266 Duillier, Suisse.
  3. Following receipt of the product by N’JOY, it is tested by means of a quality control in order to certify the validity of the warranty case. 
  4. If the warranty conditions are fulfilled, the product will be, at N’JOY’s discretion, either repaired or exchanged (if a similar product is available) within a reasonable period of time.
  5. If the product cannot be repaired or exchanged within a reasonable period of time, the price of the product under warranty will either be refunded in full or partially refunded (product discount) at the customer’s discretion. N’JOY will pay for the return shipping costs.
  6. If the guarantee conditions are not fulfilled, the article will not be repaired, exchanged or reimbursed by N’JOY and any return costs will be charged to the customer, payable in advance. N’JOY reserves the right to keep products in store for which the return costs have not been paid. The customer bears the risk.
  7. The customer has no further claim against N’JOY.
  1. LIABILITY

Passing of risks 

Risk shall pass to the customer on delivery.

Product suitability

In the event of the sale of products, N’JOY is in no way responsible for their compatibility or suitability with the customer’s vehicle(s).  

Without prejudice to the scope of the Terms and Conditions, no claim, of any kind, relating to the delivered products or the non-delivery of the products or any other claim shall exceed the purchase price of the products in question. In no event shall N’JOY be liable for any indirect, incidental or consequential losses of any nature whatsoever in connection with its products, their use, sale or the content of this Site.

N’JOY declines all responsibility in the event of illegal purchase or inappropriate use of its products.

 

Loss of income

N’JOY shall not be liable to the client under or in connection with the purchase contract for any loss of income, loss of actual or anticipated profits, loss of business, loss of contracts, loss of goodwill or reputation, loss of anticipated saving, loss of damage to or corruption of data, or for any indirect or consequential loss or damage of any kind, in each case howsoever arising, whether such loss or damage was foreseeable or in contemplation of the parties. 

 

Force majeure

N’JOY accepts no liability for delays in delivery caused by events beyond its control, such as the following cases of force majeure: epidemics, strikes, extreme weather conditions or the detention of goods by the authorities. Such events do not entitle the customer to withdraw from the purchase contract or to claim compensation from N’JOY for the damage caused.

Limitation of liability

N’JOY’s total liability arising in connection with the performance or contemplated performance of the contract shall be limited to the purchase price of the products and/or services. 

  1. DATA PROTECTION

Your personal data will be collected exclusively in compliance with legal requirements and will be processed in accordance with our Privacy Notice. 

  1. SEVERABILITY

If any of the provisions of these Terms and Conditions are found to be null and void, the remaining provisions shall remain valid and shall continue to bind the Parties. Invalid terms will be replaced by the applicable provisions of Swiss law. 

  1. APPLICABLE LAW

These General Terms and Conditions of Sale shall be governed in accordance with the Federal Laws of Switzerland without reference to its conflicts of law rules. The exclusive place of jurisdiction is Nyon, Switzerland.
